Service and Marketing Messages

We may use your information to contact you about product and service offerings by email or otherwise. You have the right to opt-out of such messages. We may use your information to investigate, respond to and resolve legal, security or technical issues and complaints and as necessary for security purposes or to investigate possible fraud, or violations of law. We may use your information to contact you about these security, legal and other service-related issues. Please be aware that you cannot opt-out of receiving such messages from us.

Legal Notices

We may use your personal information to provide you with notice regarding a security incident or data breach, by: (a) sending a message to the email address you provide (as applicable); (b) posting to a publicly facing page of our website; (c) through major statewide media; and/or (d) telephonic means, including calls and/or text messages, even if sent via automated means including automated dialers (standard text and data messaging rates may apply from your carrier). Notices sent by e-mail will be effective when we send the email, notices we provide by posting will be effective upon posting, and notices we provide through telephonic means will be effective when transmitted or dialed. You consent to receiving electronic communications from HailTrace relating to any security incident or data breach. It is your responsibility to keep your email address and any other contact information you provide to us current, so that we may provide these communications to you.

Connected Applications and AI Features

You can connect other software to our Services, such as AI assistants, CRMs and other integrations (“connected applications,” called “Connected Clients” in our Terms of Service). When you connect one:

  1. We never share your HailTrace password with the connected application, and you can disconnect it at any time in that application’s settings or by contacting us.
  2. We receive the requests the application sends to our Services, such as addresses and search terms, and use them to respond. We do not receive your other activity in that application, such as your conversations with an AI assistant.
  3. We keep records of that activity, such as the application and feature used, time, outcome and IP address, to operate, secure and improve our Services.
  4. Information we send to a connected application leaves our systems, and that application’s provider handles it under its own terms and privacy policy. That provider’s terms and settings, not HailTrace, determine whether it uses that information to train its AI models.

Some of our Services also include AI features that HailTrace provides. To respond to your requests, these features may send the information needed to AI service providers that process it on our behalf, as described in “Sharing Information” below.

Information About Property Owners, Occupants and Businesses

We license information about owners and occupants of residential and commercial properties, including businesses and their contacts, from third-party data providers, such as names, contact details, demographic, financial, business and property attributes, and do-not-call indicators. We make this information available to our customers for their marketing and sales. Our customer terms require customers to use it lawfully and prohibit using it for credit, employment, insurance, housing or other eligibility decisions.

If you are a property owner, occupant or business contact and want to opt out of our customers receiving your information, or want it deleted, contact us at [email protected]. We will stop making your information available to our customers, and forward your request to the data provider that supplied it. “Your State Privacy Rights” below explains how we verify and respond to requests.

Keeping / Deleting Your Information

We store the data we gather for varying time spans based on what it is, how we utilize it, our legal obligations and your preference settings:

  1. You may delete certain data, like your personal details, through the settings of your HailTrace account. You may also contact us at [email protected] to request that we delete information concerning you. Please note that doing so may limit your ability to use certain functionality of the website and/or aspects of our services.
  2. We retain anonymized and/or aggregated data concerning your use of our Services even after you delete your HailTrace account or request personally-identifiable information be deleted. For instance, we retain details about how frequently you use our Services.
  3. For any deletion of information, we follow our deletion procedure to ensure that your data is thoroughly and securely eliminated from our servers or kept only in anonymized form. Due to this, there might be a time gap between when you delete something and when copies are erased from our active and backup systems. Please note that our deletion will not and cannot remove or erase information used, stored or shared by you with third parties while using our Services.
  4. We keep records of activity in our Services, including activity by connected applications, for as long as we need them to operate, secure and improve our Services and to meet our legal obligations, and then delete or anonymize them.
Your State Privacy Rights

If you live in California, Colorado, Connecticut, Oregon, Texas, Virginia or another state with a consumer privacy law, you have rights over your personal information. These rights cover information we collect when you use our Services and information about property owners, occupants and businesses that we license from data providers, subject to the exceptions in those laws. This Privacy Notice describes the categories of personal information we collect, where it comes from, why we use it, who we disclose it to and how long we keep it.

Depending on where you live, you can ask us to:

  1. Tell you what personal information we have about you, where we got it, why we use it and who we disclose it to (including, where the law requires, a list of the specific third parties), and give you a copy.
  2. Correct inaccurate personal information about you.
  3. Delete your personal information.
  4. Stop selling your personal information or sharing it for targeted advertising.
  5. Limit our use of your sensitive personal information, where the law gives you that right.

In the past 12 months, we have sold (as California law defines “sell”) these categories of personal information that we license from data providers to our customers for their marketing and sales: identifiers such as names, postal and email addresses and phone numbers; demographic information such as gender; financial information such as estimated income, summarized credit scores and home value; property and business information; and inferences drawn from this information. We have also shared online identifiers and internet activity collected through advertising cookies on our website with advertising networks for targeted advertising. We do not knowingly sell or share the personal information of consumers under 16.

To make a request, email [email protected] with the subject “Privacy Request.” To opt out of the sale or sharing of your personal information. Our website treats a Global Privacy Control signal from your browser as a request to opt out of the sale or sharing of personal information linked to that browser. Our website does not respond to Do Not Track signals.

We will confirm your request within 10 business days and respond within 45 days. If we need more time, we will tell you why, and we may take up to 45 more days. Before we act on a request to know, correct or delete, we will ask you to confirm information we already have about you so we can verify your identity. You can use an authorized agent to make a request, and we may ask the agent for proof that you authorized them. We will not discriminate against you for exercising these rights.

If we deny your request, you can appeal by replying to our decision within 45 days. We will respond to your appeal within 45 days. If we deny your appeal, you can contact the attorney general of your state.

Sharing Information

We respect your privacy. Mobile phone numbers and SMS opt-in data will not be shared, sold, or disclosed to third parties or affiliates for their marketing or promotional purposes. The information collected through our SMS program will only be used to send you relevant messages as you have consented to receive. Your consent to receive text messages is not shared externally and will be retained solely for compliance and communication purposes. This paragraph applies to mobile numbers and consent collected through our SMS program, not to the information about property owners, occupants and businesses described above.

We do not share your personal information with companies, organizations, or individuals outside of HailTrace except in the following cases:

  1. With your consent. If you give us permission, we will share personal information outside of HailTrace.
  2. At your direction. When you connect another application to our Services, such as an AI assistant, CRM or other integration, we send it the information it requests on your behalf. The provider of that application is not our service provider, and its own terms and privacy policy govern the information after we send it.
  3. With subsidiaries and affiliates. We may disclose information that we collect or you provide to our subsidiaries and affiliates for our respective, internal business purposes (including to improve all of our respective services). We also let subsidiaries and affiliates collect information from your device or web browser for ads and data collection using their own tracking tools.
  4. For external processing. We also disclose personal information that we collect or you provide to third party service providers that we use to support our business (such as the management of our data, maintenance, analysis, audit, fraud detection, communication and the like) and to process your requests. These include providers of cloud hosting, databases and storage, authentication, network security, product analytics, error monitoring and logging, mapping and geocoding, payment processing, email, SMS and other messaging, customer support, customer relationship management and marketing, call and meeting recording, and AI services. These service providers will have access to your information as reasonably necessary to perform tasks on our behalf and are obligated not to disclose or use it for other purposes. These third parties may also use their own cookies and similar technologies to collect information to perform tasks on our behalf. We may also disclose aggregated non-personally identifiable information about our users, the use of the website as well as any data related to or in connection with the website that does not identify an individual, in each case without restriction.
  5. For legal reasons. It is possible that we will need to disclose information about you when required by law, subpoena, or other legal process or if we have a good faith belief that disclosure is reasonably necessary to (a) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (b) enforce our agreements with you; (c) investigate and defend ourselves against any third-party claims or allegations; (d) protect the security or integrity of the website; (e) to exercise or protect the rights and safety of HailTrace and others; or (f) in connection with merger, acquisition or sale of our assets or similar business arrangement. We may attempt to notify you about legal demands for your personal data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are unlawful, overbroad, vague, or lack proper authority, but we do not promise to challenge every demand.
Changes to This Privacy Notice

Our business changes constantly, and our Privacy Notice may also change. We may e-mail periodic reminders of our notices and conditions, unless you have instructed us not to, but you should check our website frequently to see recent changes. Unless stated otherwise, our current Privacy Notice applies to all information that we have about you and your account. We stand behind the promises we make and will try our best to never materially change our policies and practices to make them less protective. Changes to this Privacy Notice take effect 30 days after we post them on our website, or earlier for anyone who accepts them in the Services.

Security

HailTrace strives to build all its products with features designed to keep your data safe.

Here are some of the ways we protect your data:

  1. We encrypt your data in-transit to your device using industry standard tools such as TLS.
  2. We encrypt sensitive data at-rest in our data centers.
  3. We regularly check how we gather, store, and use information, including our physical security measures, to keep our systems safe from unwanted access.
  4. We limit the access to personal information to HailTrace employees, contractors, and representatives who require it to handle the information. All those who have this access are bound by stringent contractual secrecy and confidentiality responsibilities. Non-compliance can lead to disciplinary actions or even termination of their contracts.
  5. We partner with PCI-certified vendors to process your payment information.
  6. We never share your HailTrace password with applications you connect to our Services.
Third-Party Sites

Please keep in mind that our websites and mobile applications may contain links to other websites or apps, and you may connect other applications, including AI tools, to our Services. We do not control these third parties’ privacy practices or tracking technologies. If you have any questions about targeted content, you should contact the responsible provider directly. You are responsible for reviewing the privacy statements and policies of those other websites you choose to link to or from our website, so that you can understand how those websites collect, use and store your information. We are not responsible, or liable to you or any third party, for the privacy statements, policies or content of third parties, including websites you link to or from our website or the accuracy of any materials provided by third party websites.

Children

We do not collect personal information from any person we know is under the age of 18 without the consent of the parent or legal guardian of that minor. A parent or guardian may consent to the use of the website by a minor, whose parent or guardian is solely responsible for providing supervision of the minor’s use of the website and assumes full responsibility for the interpretation and use of any information or suggestions provided through the website. If you believe we might have any information from or about a child under 18, please contact us at [email protected]. If we learn and have confirmation we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information.
